Terms and Conditions of Use
Service contract between YouVisible and its users.
Parties: YouVisible and the User (athlete/agency/parent, club/scout, company/marketplace).
Account and roles
Registration and accuracy. The User declares that the data provided is truthful, complete and up to date, and undertakes to keep it current (for example, email address, role, relationship with the minor, billing data). YouVisible may request reasonable verifications (for example, email, phone or identity verification for companies/clubs).
Roles. The available roles are: (i) Athlete, (ii) Guardian/Parent or Agency (managing one or several profiles), (iii) Club/Scout and (iv) Company/Marketplace. Each account must choose a main role, without prejudice to YouVisible being able to enable multi-role accounts in certain cases. Some functionalities and permissions vary depending on the role and active subscription.
Minors and guardianship. The participation of minors requires the involvement and, where appropriate, the consent of parents, legal guardians or custodians, according to age and applicable regulations. Guardians will be responsible for the content uploaded and the privacy settings of the minor. Detailed information can be found in the Legal Notice, the Privacy Policy and in the specific policies for the protection of minors.
Use of the service
Lawfulness of content. It is forbidden to post illegal, defamatory, violent, discriminatory content, or content that infringes third-party rights (intellectual property, image, honour, personal data, etc.) or that breaches the Community Guidelines. The User declares that they hold the necessary rights over the videos, images and texts they upload, including image rights of minors and participants in trainings or matches. Deceptive deepfakes or material that violates applicable law are not permitted.
Role flow. Athletes/agencies/parents can create profiles, upload videos, achievements, statistics and link useful information. Clubs/scouts can search and filter talent, organise lists and make contact via private messaging. Companies/marketplaces can display services and offers within the sports ecosystem, always in accordance with the chosen category and content policies (for example, services unrelated to the sports or training field are not allowed). Services are displayed and contracted in the marketplace in line with current categories and policies.
Technical restrictions. It is prohibited to extract, scrape, index massively or use robots on the platform without the express authorisation of YouVisible. It is also forbidden to use the platform for purposes other than those allowed, or to create competing services.
Safe interactions. Messaging and lists must be used in accordance with the Community Guidelines and permitted flows (for example, clubs contacting profiles, companies offering services through enabled channels). Any attempt to bypass these flows, make inappropriate contact or move interactions outside the permitted channels and without guardianship where required is prohibited.
User-generated content (UGC) license
Ownership. The User keeps full rights over their content (videos, images, texts, statistics…). By uploading content to the platform, the User grants YouVisible a non-exclusive, worldwide and royalty-free licence to host it, reproduce it technically and show it to authorised users within the YouVisible ecosystem, in accordance with privacy settings and role. This licence is limited to the operation of the platform, internal quality purposes and service improvement, and to perform technical copies and backups.
Promotion. External promotional use (e.g. social networks or the public landing) requires additional authorisation from the User, except where it concerns corporate material generated by YouVisible (mock-ups, its own marketing material) that does not entail additional processing of personal data without an appropriate legal basis.
Content removal. The User can delete or unpublish their content from the platform, without prejudice to limited retention necessary for compliance with legal obligations, dispute resolution or liability purposes. YouVisible may block or remove content that it considers contrary to these Terms, the Community Guidelines or the law.
Moderation and Community Guidelines
Behaviour rules. The platform has Community Guidelines that develop the rules on coexistence, permitted language, handling of hate speech, mutual respect and responsible use of messaging and contact channels. Breach of these guidelines may result in warning measures, limitations, temporary suspensions or account closure, especially where minors are involved.
Content moderation. YouVisible combines automated systems (detection of certain patterns) with human review to moderate content and prevent abuse. Moderation decisions follow transparent and proportionate criteria. The User may be informed of the reasons for removal, limitation or suspension, as well as of any available appeal mechanisms, where applicable.
Reports and flags. Users can report content, accounts or interactions they consider inappropriate or in breach of these rules. YouVisible undertakes to review reports within reasonable timeframes, prioritising those affecting minors or potential serious risks.
Privacy and data protection
Data controller. YouVisible acts as Data Controller for personal data processed through the platform (except in cases where it acts as processor for a third party, which will be governed by specific agreements).
Purposes and legal basis. Data is processed to manage accounts, profiles, content, interactions, subscriptions and contracted services, as well as to ensure security, fraud prevention, moderation and service improvement. The legal bases include contract performance, compliance with legal obligations, legitimate interest and, where applicable, consent.
Rights and settings. The User can exercise their rights of access, rectification, erasure, objection, restriction, portability and others recognised by law, as described in the Privacy Policy. They may also configure profile and content visibility, in particular in the case of minors, by adjusting privacy preferences and contact channels.
Minor’s data and guardianship. Minors’ data will be processed with special protection, requiring the consent or involvement of those exercising parental authority or guardianship, according to age and applicable rules. Additional security measures, anonymisation or pseudonymisation will be applied where appropriate.
Payments, subscriptions and marketplace
Subscriptions. Certain functionalities are provided under paid modalities (plans, subscriptions, add-ons). Economic conditions, duration, renewal and cancellation are detailed on the platform and, where relevant, in specific commercial terms that supplement these Terms.
Payments. Payments will be made through the enabled methods (payment gateways, cards, other compatible means). Payment data may be processed by external providers (gateways) acting as processors, in accordance with the required security measures.
Marketplace. Companies and providers offering services through the marketplace are directly responsible for service provision and for the information supplied. YouVisible generally acts as an intermediary for services and does not assume direct responsibility for execution of the services offered, unless otherwise expressly stated or where specific liability is imposed by law.
Billing and receipts. The User will have access to receipts, invoices and details of subscriptions or purchases in accordance with applicable rules and as indicated on the platform.
Liability
Of YouVisible. To the maximum extent permitted by law, YouVisible shall not be liable for indirect damages, loss of profits, loss of data or any other damages arising from the use or inability to use the platform, except in cases where the law imposes non-excludable liability (for example, in consumer and user matters).
Of the User. The User is responsible for their use of the platform, for content they publish and for interactions with other users, clubs or companies. They shall also be responsible for the consequences of providing false, incomplete or third-party data without lawful basis.
Third-party services. The platform may integrate third-party services (for example, payment gateways, analytics tools, external storage) the internal operation of which is not controlled by YouVisible. The liability of such services is governed by their own terms and policies.
Termination and suspension of the service
Termination by the User. The User may terminate their account at any time from the configuration options, without prejudice to limited retention of data necessary to comply with legal obligations, handle incidents or defend claims.
Suspension or termination by YouVisible. YouVisible may suspend or terminate access to the platform or certain functionalities where it detects serious or repeated breaches of these Terms, the Community Guidelines or the law, or where necessary to protect minors, other users or the service itself. Decisions will be taken in a proportionate manner and, where appropriate, the User will be informed of the reasons and any available avenues of appeal.
Effects of termination. Termination of the account or contractual relationship does not affect accrued obligations (for example, outstanding fees, liability for damages) or obligations that, by their nature, must remain in force (for example, some confidentiality or data protection duties).
Scope and hierarchy
Relationship with other documents. These Terms are integrated with the Legal Notice, the Privacy Policy, the Cookies Policy, the Community Guidelines and any specific commercial conditions published in relation to paid services or particular functionalities.
Conflicts of interpretation. In case of conflict between these Terms and specific conditions of a service or subscription, the latter shall prevail with regard to that service, unless expressly stated otherwise.
Updates. YouVisible may update these Terms to adapt them to legal, technical or service changes. In such a case, the User will be informed by reasonable means (notices on the platform, email, etc.), indicating the date of entry into force. If the User does not agree with the new version, they may stop using the platform and cancel their subscriptions.
Governing law and jurisdiction
Governing law. These Terms are governed by Spanish law and, where applicable, by European law or other consumer/user or digital services regulations that may apply. In the case of Users resident in other countries, mandatory public policy rules of the User’s country of residence may apply where relevant.
Jurisdiction and dispute resolution. For users considered consumers, the competent courts will be those of their domicile or those established by applicable consumer law. For professional or business users, unless a mandatory rule provides otherwise, the parties submit to the courts and tribunals of the city indicated in the Legal Notice. Online dispute resolution (ODR) platforms or alternative dispute resolution (ADR) bodies available in the User’s country (e.g. equivalent ODR/ADR platforms) may also be used.
Local clauses. Specific conditions or annexes may be added for certain countries or regions (for example, mandatory notices, additional rights, tax or consumer specificities), which will be communicated clearly and accessibly to the User (for example, during sign-up, in account settings or by specific email), and which will prevail locally over this general text.
